There is an obvious relationship between the early developmental years and future success in both academic and social pursuits. In terms of the use of the standards themselves, the document recognizes the importance of creating a framework for caregivers and teachers to understand while acknowledging that the standards are limited by individual variations in development and should not be used as the sole device for assessing individual children. That said, however, the standards are a useful tool for choosing curricula and determining adequate provision of services and experiences. It provides for assessment as a positive process, which brings about benefits for the children from whom the data was collected.

They are concerned with how expert ideas and welfares are to be weighed against the necessity to maneuver a system that works for the greater good of the public. Nurses and physicians work hand in hand for the cure and betterment of their patients; but what makes them different from each other? Some say it’s better to be a doctor for one has the capability to save lives; others say it’s more fulfilling to be a nurse because you not only help offer cure for the sick, you also give them genuine care. Moreover, applying and promoting caring values in the nurses’ practice is not only necessary to their own health as nurses, but its implication is also deeply tributary to finding meaning in their work. Upholding caring values in the nurses’ every day practice helps go above the nurse from a state where nursing is thought as just a job to that of a rewarding profession. While many people see medicine as a better profession than nursing, they don’t realize that nurses also encompass the competence and deep levels of character. The changes in the delivery systems of health care around the world have intensified nurses’ workloads and responsibilities. Nurses must know how to deal with patients’ increased acuteness and intricacy with regards to their health care condition. Regardless of such hardships, nurses are able to find ways to conserve their caring practice. Giving care to different individuals several hours a day is no easy job. This paper will enlighten people to what the nursing profession really is by discussing the theory of human caring. Jean Watson’s caring theory can be seen as essential to this aim. While the sole focus of medicine is to diagnose a patient and cure his/her disorder or disease, nursing entails giving care to the patient. Without care, the cure for the disease would be possible, but the illness would still linger because health would still not be attained without caring. The core of nursing is caring, while that of medicine is cure. This paper doesn’t imply that medicine does not include caring for patients. It’s just that nursing implies caring in a deeper, more attached way. The nursing profession involves working long hours with the sick, developing rapport in every possible way, and acknowledging every patient whatever their attitude or race may be. Nursing and caring have always been thought of as acting in unison. Most people choose nursing as a line of work because of their longing to care for other persons. Watson’s caring theory not only allows the nurse to live out the art of caring, it also seeks to offer compassion to ease families’ and patients’ suffering, and to support their dignity and healing. According to Watson (2001), the chief elements of her assumption are: the carative factors, the transpersonal caring relationship, and the caring moment or caring occasion. These fundamentals are described later in the paper, and will be exemplified and viewed in light of the nursing and medical profession. The caring theory or model can also be measured as an ethical/moral and philosophical foundation for professional nursing and a division of the vital focus for nursing at the corrective level. A replica of caring includes a call for both science and art; it provides a structure that intersects and embraces with science, humanities, art, spirituality, and a new magnitude of body, mind, and spirit. Nursing and medicine is developing openly as a core to human phenomenon of the nursing practice. Carative factors are viewed as a guide for the nursing core. Watson uses the word carative in contrast with medicine’s curative factors. She uses the carative factors for the reason of honoring the human magnitude of the work of nursing and the subjective experiences and inner life world of the patients that they serve. The carative factors have ten elements: faith-hope, humanistic-altruistic system of value, expressing positive and negative feelings, helping-trusting human care relationship, transpersonal teaching-learning, creative problem solving caring process, human needs assistance, supportive, protective and corrective physical, mental, societal and spiritual environment, and existential phenomenological spiritual forces. This however evolved into the caritas process which has a deeper spiritual magnitude and dimension which means to treasure and to give exceptional loving attention (Watson, 2001). Transpersonal Caring regards the harmony of life and relations that move in concentric circles of caring from a person, to others, to the society, to the world, to our planet, and to the universe. Transpersonal caring is established in a happening or actual caring instance. It shows concern for the life within. The patient is regarded as complete and as a whole, in spite of disease or illness (Watson 2003). The transpersonal nurse looks for a connection to embrace the soul or the spirit of the patient, by way of healing and caring (Watson 2003). Caring in the nursing career takes place each time a nurse to patient contact is achieved. Unlike in medicine, some doctors may look at a patient and just prescribe a drug, after that, their deal is finished. In contrast, the nurse seeks to enter the patient’s world in order to draw closer and know the patient as a caring individual, and that it is from this epistemology that the caring of nursing begins to unfold (Schoenhofer 2002). This connection describes how the nurse goes further than an objective evaluation, presenting concerns toward the person’s deeper and subjective meaning concerning their own health care condition. The nurse’s caring realization becomes vital for the association and understanding of the other person’s point of view. This approach highlights the exclusivity of both the nurse and the person, and also the mutuality linking the two persons, which is primary to the bond. As such, the one cared-for and the one caring cooperate in connection in mutual search for wholeness and meaning perhaps for the sacred transcendence of suffering (Watson, 2001). The term transpersonal means to go further than an individual’s own ego and the here and now, while it allows him/her to arrive at a deeper spiritual connection in promoting the patient’s healing and comfort. Lastly, the objective of a transpersonal caring association corresponds to enhancing, protecting, and preserving the person’s humanity, dignity, inner harmony, and wholeness. According to Jean Watson (1988, 1999), a caring occasion is the moment (central point in time and space) when the patient and the nurse come as one in such a way that an instance for human caring is formed. Both persons, with their exceptional and phenomenal fields, have the likelihood to move toward together in a human-to-human contract. The one being cared for and the one caring for are predisposed by the actions and choices decided within the affiliation. For Watson (1988, 1999), a unique field correspond to the person’s frame of orientation or the entirety of human experience consisting of bodily sensations, feelings, spiritual beliefs ,thoughts, goals, environmental considerations, expectations and meanings of an individual’s perceptions, all of which are based upon one’s present moment, and one’s anticipated future. At the end of the day, they still hold their faces up high and continue caring for every other patient they will be encountering in the future. Caring entails love and loving is not an easy thing to do. It is said that while a nurse enters into a patient’s room, a compelling field of expectation is produced. In this deeper, more stretched out way of thinking about the power, energy, and beauty of love, a caring moment (Watson, 1999b) becomes a vibrational field of cosmic love full of life that radiates mutuality and reciprocity, which transcends space, time, and physicality sustaining and confirming our humanity and our association with the Levinas. The infinity of the whole universe (Quinn, 1992). This ethic of caring and loving becomes the first philosophy for sustaining and facing the infinity of the nursing profession. If nurses follow this ethical order, nursing has a serious role in moving humanity in the direction of the omega point, ever closer to God and the unexplained blessed circle of loving, living, dying, trusting, and being. Lastly, a quote to ponder on the care illuminated by the nursing profession in contrast with that of medicine: â€Å"The heart is as broad as the sky, because it can embrace joy and pain side by side. † Even in the midst of hard to deal with patients, nurses still choose to care.

Common arguments about the Atkins diet is it greatly affects a persons health, one major disease that the Atkins diet has been blamed of is heart disease as well as heart attacks. Organizations such as the American Heart Association and the American Dietetic Association have been criticizing the Atkins Diet on its unhealthy way of losing weight. Other side effects such as headaches, constipation, bad breath, muscle cramps and more has also been added to the ever growing effects that Atkins diet can cause to a dieter. Another increasing argument that is against the Atkins Diet is that it affects a dieter’s mental health, causing the dieter to feel grumpy, tired, restless and apathetic. The Atkins Diet has been known not to limit dieter’s intake on proteins and fats which made numerous health organizations and medical professionals criticize it. With its focus on fatty foods and meats which is high in saturated fat it is believed to increase blood cholesterol levels and may even lead to heart attack. On the Atkins first phase (induction phase), a dieter is only allowed 20 net grams of carbohydrates per day, this leads to not having enough source of calcium or vitamin D that researchers say may play a role in illness such as heart disease and diabetes. There are five forces that shape competition in an industry, barriers to entry, power of suppliers, power of buyers, threat of substitutes, and rivalry & industry structure. These five forces that Porter developed have become a strong framework in helping strategic mangers find answers as to how, or why decision can have an impact on their firm, and the industry they operate in. When analyzed the collective strength of these forces show potential profits of an industry. The company being focused on is EMC, which is in the Computer Peripherals industry. Barriers to entry are forces that firms must overcome in order to enter an industry. These barriers can be caused from high initial investment, product differentiation, cost disadvantage, access to distribution channels, or restrictive government policies. An example of this could be the phone, or cable companies. There are very few companies that are able to compete within this industry because of the high capital requirements to start off. An enormous amount of time and money would have to be spent on installing lines throughout the country to supply you customers with the services they want. EMC is in a situation where it has created several barriers to entry. Capital requirements are one of the barriers that EMC has in its favor. In 1979 EMC started its business in data storage which it is now the leading company in its industry. It has offices all over the globe and is the only company in the world to be specifically focused on rapidly delivering intelligent enterprise storage and retrieval solutions. There are very few companies that can compete with EMC because of its name association and large international operation. New entrance into this industry would have to invest large amounts of time and money into research and development. EMC already has the technology and is constantly updating with more advanced services. Another barrier to entry is product differentiation. EMC is specialized in enterprise storage, which is much different than conventional storage. While conventional storage has been used to back up memory in case of a disaster or, to log companies transactions, EMC started a niche which it has made into a new industry. Enterprise storage has six specific parts that set it aside from conventional storage. They are as follows enterprise connectivity, information centricity, cascadability, information management, information sharing, and information protection. It can be clearly seen that this industry is constantly changing, and new products are coming out every day. If you are not the leader in this new technology then you will not survive. EMC has without a doubt developed barriers to entry. The threat of substitutes is how easily a product can be interchanged with another. For example if you are going to buy bottled water you decision will ultimately come down to price. An expensive flashy bottle of water can easily be exchanged for a generic store brand bottle at a fraction of the cost. However with services it is a different story. Lawyers for example could easily be substituted if you were looking at the cost. It would be very simple to find a cheap lawyer, however you might end up losing your case. To get a top of the line service you will have to pay a little extra. EMC is a top of the line service which also offers a very affordable pricing strategy. Its pricing very sensitive with the companies it works with, whether you are a world dominating bank, or a newly started Internet company. EMC has something to offer everyone. What makes EMC even more attractive is its unmatchable customer service. Customers are always kept in close and frequent contact whether it be for unforeseen problems, or to validate new features. Customers have found that EMC offers the best of both worlds, and that no other company so far can be substituted for it. â€Å"We need high capacity, fast performance, a scalable platform, and total data protections. With EMC, we found a complete solution from one provider.† Says the General Manager of information technology, at Komercni Banka. This clearly shows the EMC has eliminated its substitutes by offering something that no one else can match. Rivals in any given industry are a part of competition that businesses have to deal with. For the past several years EMC has not had to deal with many competitor since they offer services and customer support that surpasses any other company that has been looking to get into the the information storage industry. IBM, and Sun Microsystems are two companies that have recently been competing with EMC. These are both large established companies that deal in many different aspects of the technology industry. Both IBM and Sun Microsystems have begun to compete with EMC†s self started indusrty. The reason for this is because they both have large R&D departments with large budgets that allow development of product comparable to EMC. However since EMC is so focused in their niche market they have a mixture between service and product quality that hasn†t been matched by anyone. IBM Sun and the other competitor are not focused just on storage technology but they also have many other interest. This makes companies weary of handing over valuable information to a business that could be in direct competition with them. This gives EMC a competitive advantage over any other company since they are well known for tight security. Another advantage EMC has over its competitors is that they are now recognized as the â€Å"standard: in computer information back up and storage area.

According to Friis, epidemiology has to do with the distribution and determinants of health and diseases, morbidity, injuries, disability, and mortality in populations. It is considered a basic science of public health, because its studies are applied to the control of the various health problems in the population. Also, its methods are applied to various health-related fields such as health care administration and health education. Because its focus is on the amount of health and disease in the population, it is at times referred to as population medicine. There are various uses and applications of epidemiology. Some specific applications of epidemiology that Friis did not specifically mention in lesson 1are genetic epidemiology, environmental epidemiology, and occupational epidemiology. Genetic epidemiology puts an emphasis on hereditary factors that may play a role in various human diseases in families and in populations. Research in this area is focused on the risk factors and traits of the genetic basis of diseases. Members of a Psychiatry department in Virginia completed a meta-analysis on the genetic epidemiology of major depression using relevant data from previous primary studies. They concluded that major depression is as a result of genetic influence, not alone, but along with environmental influence. This conclusion was made on the basis of a review of family, adoption, and twin studies that met specific criteria for the primary studies. Environmental epidemiology studies the environmental exposures that are related to various diseases, illnesses, developmental conditions, disabilities, and deaths in populations. Some examples of these environmental exposures are air pollution, radiation through air, water, or food contamination, second-hand smoke, and hazardous waste. Health conditions such as cancer, cardiovascular disease, and reproductive problems are some of the effects of these environmental exposures. A local example of this is the pollution from the refineries here in Corpus Christi. People who reside near the refineries have a 17% higher cancer rate than the rest of the city. There are apparently many consistently sick residents in the area. They are called the ‘Black Thumb’ neighborhood, because the soil in the area is poisoned and contaminated by the pollu tion from the refineries. The application of epidemiologic methods to populations of workers is occupational epidemiology. Studies on this topic involve various work-related patterns of disease and illness. They look at workers exposed to various risk factors such as heavy metals or chemicals and determine if these exposures result in adverse health outcomes. There is also a focus on biological and physical health effects as well. Occupational Epidemiologists attempt to study how often workers are injured on the job, what groups are most affected, and the reasons for these injuries. The results from these studies are used to find ways to prevent or reduce the risks of injuries and illnesses on the job. In conclusion, the various epidemiologic methods and studies are applied to the control of health problems in populations. Three specific applications of epidemiology are genetic epidemiology, environmental epidemiology, and occupational epidemiology. Genetic epidemiology is concerned with the role of genetic factors in determining health and disease in families and in populations. Environmental epidemiology is concerned with the relationship between exposures from the environment and adverse health outcomes in populations. Occupational epidemiology studies work-related patterns of disease and illnesses. The existence of these various epidemiologic applications help to identify and prevent the causes of health and disease in our communities. Wittingly, these assassins painted Caes ar as a king by offering him several honors. Unfortunately, Caesar gave in to the ill plans of these brutes and as time went on, he started acting against the law, something that would cost him life. The disregard for the law would give the assassins a foothold to censure him. The conspirators started by voting on how Caesar would appear in public. According to the vote passed, Caesar was to appear in all public places wearing exultant attire and sit in the chair of state. The aim of this vote was to make bring him close to people who would easily fault him as he mingled with them often. He went ahead to rub their names from tribune-ship; however, this did not quell the mounting disapproval among citizens. Did he really dissent the title? The answer to this question is no! If Caesar were totally, against the title, he would come out clearly and refuse it. However; Antony with his fellow priests saluted him as king and surrounding his brows with a diadem said: â€Å"The people give this to you through my hands.† He answered that Jupiter alone was king of the Romans and sent the diadem to him to the Capitol, yet he was not angry and caused it to be inscribed in the records that the royalty presented to him by the people through the consul he had refused to receive. It was accordingly suspected that this had been done by some prearranged plan and that he was anxious for the name but wished to be somehow compelled to take it, and the consequent hatred against him was intense (Cassius Dio 1949, 17). This shows that he somehow accepted the title â€Å"king†; hence, making him a tyrant. Thus, the assassination would not be branded as such, but it would be called tyrannicide. However, Caesar was still popular amongst middle and lower classes and they vowed to fight Brutus and his team. The fact t hat Brutus went to organize troops in Greece to topple Antony is a clear indication that all he wanted was power. Conclusion Despite his ingenuity in conquering his enemies, Caesar could not deal with his closest enemies who disguised as friends. They led him into believing that they liked and honored him by awarding him with several accolades until they won his trust. First, they had to win his trust to a point of him letting go of his guards. This would ensure that the senators gained access to Caesar and have the opportunity to kill him. Luckily, this worked well for them as they accomplished it. Secondly, they had to paint Caesar as a tyrant in the eyes of the citizens to justify their assassination, which in effect it would be termed as tyrannicide. They also accomplished this by branding him a ‘king†, a title that he was not supposed to hold. Their craftiness was aided in part by Caesar’s gullibility and failure to read the two sided of the coin. There is cl ear indication that Caesar wanted to be called a king and this was the biggest mistake that he made. However, this assassination was inevitable and nothing he would have done to prevent it. It was a political attack where the assassinators were power hungry and the only way they could gain it was through assassination. Take off Take off Take off By Maeve Maddox A reader asks about the phrase â€Å"take off†: I read a line that said take off Saturday, which I had always understood to be â€Å"to take Saturday off.† What do you think? â€Å"To take off† is a phrasal verb used with more than one meaning. When the sense is â€Å"to stay away from work,† the particle off may appear next to take or following the day mentioned as being taken off. For example: I felt wiped out, and I was dreading Sunday each week, so I decided to  take Saturday off  to have a very simple day to read and explore my purpose in life.   The new law entitles  workers  at factories, eateries, hotels, movie theaters and private hospitals to  take off Saturday  or Sunday.   â€Å"Take Saturday off† may be more common, but â€Å"take off Saturday† is not incorrect. Here are some other examples of take off used as a verb: Do you take your shoes off while on a plane? (remove) The video shows a UFO that appears behind a commercial airliner taking off from the airport. The Balance recently published an article highlighting the uphill battle millennials currently face in the job market today, along with practical job searching tips they can employ as young workers in the constantly evolving professional landscape.According to the article, â€Å"Even as the job market has recovered following the Great Recession, unemployment for millennials continues to remain high when compared to older, more experienced workers. Marshall was in a tough predicament as he needed to deliver a fair ruling but knew that the Supreme Court had little power. Jefferson could have possibly ignored a ruling that did not benefit his administration further degrading the power of the Supreme Court. When considering this claim, it is easy to oscillate drastically to one side or other of this argument. Someone seeking to defend religion would point at the acts of Mother Theresa, to the charity of religious organizations, and to the benefits that organized religion can give to people personally, such as peace and comfort. Detrac tors from religion, however, can point to the attacks of Sept. 11, or the Crusades, and decry religion as a destructive force that causes hatred and violence throughout world history. Neither of these answers are fully correct, however. Rather, religion often does not make a significant amount of difference in and of itself. Religious actions, either positive or negative, are often results of complex societal interactions rather than religious fervor: so the Dali Lama is incorrect, as I believe that religion has not been a consistently positive nor negative influence on the progress of world history. One of the first things that must be understood in this discussion is the relationship between religion and spirituality. Though these are very closely linked ideas, â€Å"the Dali Lama distinguishes between spirituality and religion† (294). This is because spirituality and religion happen on very differ planes – spirituality is a personal, though often sometimes communal thing, that has to do fundamentally with belief in the underlying structures of the world, and one’s place within them. Religion, though resting on spirituality, is a very different thing. It is a structured organization that codifies beliefs and practices, almost like creating rules and laws for spirituality. This difference is important because many of the impulses often attributed to religion may in fact be spiritual. Altruism, for instance, is often one of the things most lauded about religious people and institutions. But there are obviously many people who are altruistic without being religious – they do good out of a fundamental belief that it is good to do so, which is much more akin to spirituality than religion, while there are also certainly religious people and institutions that are far from being altruistic. So when analyzing the impact that religion has had on the world, one must isolate the religious side – the order and structure of beliefs and a ctions, from the spiritual side. The characters personality evolves over time, and this helps to analyze the tragic themes of the novel which are oppression, hope, and internal strength of women. Some people say abortion is a womens rights issue. Other people say its an issue of morality, and still others an issue of just being right. The issue of abortion rights is an opinionated controversy in public life. Every person has an opinion about abortion rights, and it seems that a moral objective has become divided into two different arenas-social issues vs. religious issues, with the Church and the politicians in the direct line of fire. On one side of the abortion rights debate are the pro-life proponents. In the United States, the position of most Christian churches is that the Church has something to say about public life and the good society. The primary involvement of the U.S. Catholic bishops in public life in the last decade focused on abortion. The movement is not flexible, and while the movement recognizes that some women might not be ready to become mothers, pro-life supporters offer women a chance to give up their babies or offer support services. The pro-life movement is simple: abortion is murder and murder is bad. Pro-lifers measure life as beginning at the moment of conception. Anything which may disrupt a pregnancy (including birth control) is wrong. On the surface, the pro-life movement seems to impact the reproductive rights of women-because it does. While Roe vs. Wade 1973 allows women the right to choose to have elective abortions, pro-life supporters believe that the law abortion 3 should stop this from happening. Pro-lifers believe that all abortions are wrong and that every baby should have a chance to be born. The pro-life movement gave rise in the sixties. The proponents maintain that the fetus is alive and human. They believe that the unborn fetus is a person and physically independent, and as a person, the fetus has human rights. Pro-life believers agree that killing an unborn fetus is murder. There appears to be a competition between the U.S. Catholic and American politics. The bishops describe abortion and euthanasia as pre-eminent threats to human dignity because they directly attack life itself. The bishops declare that killing an unborn child is evil and to make such an evil action legal is wrong. Their opposition to legal abortion is the primary social issue. The Churchs teaching that direct abortion is morally wrong has become a tradition in the Church itself-the Church teaches that abortion is not only morally wrong, it is murder. Pro-lifers argue for the rights of unborn fetuses. Catholic moral teaching is based on the dignity of the human person, and the principles based on this foundation of human dignity apply across the board to all life issues. Abortion is now the fundamental human rights issue of today. The outcome of the debate between pro-choice and pro-life opponents needs to be politically correct and morally right. Pro-life and pro-choice are terms of political framing. The Catholic Church does not give women a personal choice in the abortion issue. Abortion is murder and pro-life is anti-abortion. The pro-choice believers support and work towards preventing unwanted pregnancies, reducing abortion, promoting contraception, educating women and youth, and ensuring that families have the necessary resources to raise healthy happy children. Abortion clinics and hospitals follow proper protocol for abortion. These clinics must provide full information on the risks and side effects and procedures. They must allow a woman to view the embryo, inform her if there are twins, and provide fetal development photos. The Catholic Church says that killing an unborn child is evil and to make such abortion 6 an action legal is wrong. The Church interprets abortion as killing and teaches that killing is a mortal sin. I question where the interpretation comes from: the Bible? The Ten Commandments? The Vatican? The Church thinks that abortion is a threat to human dignity because it directly attacks life itself. The moral issue of abortion becomes a social issue because of the Churchs opposition to legal abortion. They are saying that the act of making an abortion legal is wrong. Its almost like blaming the lawmakers for the sin of abortion. Then, they want the law to enforce their teachings. The abortion issue is not whether a woman is committing a sin by having an abortion, its who is legally responsible for her decision and the outcome. A woman should have the rightful freedom to believe what she wants to believe, and her sin (if it is a sin), is between her and God-not the Church, and not the law. The Church does not give women a personal choice in the abortion choice, therefore, they are taking away their fundamental human rights. I am not going to debate whether pro-life issues are correct or false, but rather, try to understand what pro-life is, what it means, and why its still being argued as the right way. On the other hand, the pro-choice movement is an ethical view that women should have the choice to continue or terminate a pregnancy. If abortion is not legal, women will return to illegal unsafe abortions. I believer that a woman should have the RIGHT to choose what to do with her body, and at the same time, I support the teachings of the Catholic Church that abortion is morally wrong. Abortion is a moral choice for any woman wishing to abortion 7 control her body-and this should be a certain unalienable right. If I were attempting to exercise my right of choice to have or not have an abortion, I would need to ask myself the following questions: -Is the fetus alive? Of course. Dr. Alexander manette was a prisoner in the Bastille for 18 years. He is released and taken back to London by Jarvis Lorry of Tellson Bank. Dr. Manette is a little crazy because of all the years he spent locked up in solitary confinement. He has a daughter, Lucie, who was a young girl when he was sent to prison. On a boat trip, Lucie meets a young man named Charles Darnay and is taken with him. They discuss the American Revolution. Darnay is a Frenchman, but he has relinquished the title of his nobility. He is tried for treason in England. However, Darnay's lawyer, Sydney Carton, points out that there is no way to prove that Darnay could have done it because the two men look alike and the witness could not say for sure that it was Darnay. Despite this brilliant defense (on which Darnay is released) Carton leads a solitary life of drunkeness, playing secone man to his boss, Stryver (who is by all means incompetent). By this point, Carton, Darnay, and Stryver all want to marry Lucie. She chooses Darnay and they are married. Right before the wedding, Darnay mentions to Dr. Manette that he has something important to tell him. Darnay tells him that he is Charles St. Evremonde, the nephew of the Marquis St. Evremonde, who was responsible for Dr. Manette's imprisonment. When Darnay tells him this, Dr. Manette falls back in to his stupor. Darnay is convinced by the Revolutionaries to return to France by a fake letter from an old servant. Upon his arrival, he is arrested for being an aristocrat, even though he renounced his property. Unfortunately, Darnay is not as lucky in his second trial. He is condemned mainly on the testimony of his father-in-law, Dr. Manette, who wrote a statement against the Evremondes while still imprisoned. He is sentenced to death. Out of love for the Manette family and Lucie in particular, however, Sydney Carton goes to Paris. He manages to smuggle himself into prison and Darnay out.

The task given to me for the following essay was: – Assume you have been called in to investigate suspected incidences of computer crime enacted through the computer system at a local betting office. Describe how you would conduct the search and seizure operation. Also explain why you would conduct the operation in the manner you describe. Keywords: – Electronic, Evidence, Investigation, Computers, Seizure, Forensic, Computing Introduction I was recently given the task of Head of Forensic Computing Investigation into Operation Gamble. Operation Gamble had been in place for over 12 weeks, in this time it had become obvious that there was every possibility that some kind of computer crimes were being committed on a everyday basis. This job entails making sure that nothing is overlooked, that everything is done in a methodical manner, everything needs logging in one way or another. There are many things to think about , and many that need acting upon, decisions often need to be made on site at the time of the search. Hopefully this essay will inform the reader of a little knowledge into the world of forensic computing investigation. Also that it will become clear that the successful prosecution of offenders means that the investigation must be done thoroughly from start to finish. ACPO state there are 4 principles that should be adhered to at all times, so when reading this must be took into consideration. The four principles are as follows:- Principle 1: No action taken by law enforcement agencies or their agents should change data held on a computer or storage media which may subsequently be relied upon in court. Principle 2: In exceptional circumstances, where a person finds it necessary to access original data held on a computer or on storage media, that person must be competent to do so and be able to give evidence explaining the relevance and the implications of their actions. Principle 3: An audit trail or other record of all processes applied to computer based electronic evidence should be created and preserved. An independent third party should be able to examine those processes and achieve the same result. Principle 4: The person in charge of the investigation (the case officer) has overall responsibility for ensuring that the law and these principles are adhered to. Ruth Sutton’s investigation into a local betting shop. Firstly I was called into the office and was allocated a new case, which involved investigating a betting shop that may have been involved in some kind of fraud or computer misuse. I wasn’t given any information in detail. Without having much detailed information I have to prepare the investigation as though I am looking for every kind of electronic crime there is. With an open mind it makes the investigation much more through and lengthy, maybe turning up more clues to what has been occurring in this particular establishment. Also as I have been put in charge of this investigation I make sure that all staff that had been drafted in to help with this investigation had the expertise to do so, they all needed to be aware how volatile forensic data is, how easily evidence can be lost, changed, or altered and therefore inadmissible in court. If I were to be given this case and was previously made aware that it was child pornography that I was looking for this would set my mind thinking, and turning into the direction of looking for not only images but perhaps photography equipment, chat logs, email, internet usage logs. On the other hand it is a much different case for fraud. Accounting would be looked into address books, credit card data, calendars, credit card skimmers, the list just goes on and on. Having no idea could turn up more things as child porn can often be attached to a ring, perhaps in that ring credit card fraud is being used to purchase entry to child porn sights, so with my open mind and that of my colleagues I start my investigation. Within the ACPO (Association Of Chief Police Officers) guidelines there are 4 stages that are involved in gaining forensic evidence. They are: – 1. Acquiring the evidence 2. Identifying the evidence 3. Evaluating any evidence found 4. Presenting the evidence. For the purposes of my investigation in fact all forensic computing investigations, the first 3 rules are paramount as they all rely upon each other being performed correctly. Although it must be said if any of the rules are not followed correctly this wouldn’t even get as far as the presenting Evidence rule, as there could be no successful prosecution. Preparation Knowing this is a retail betting shop, the first decision to be made is the time that we will serve our warrant to search the premises. After not much deliberation it is decided to carry out the search before opening time, I was aware that the manager opened up every morning at 8am so meeting him as he opened up would be the best policy. The reason for this decision is that with less staff and no customers there would be less chance of anyone being able to tamper with any networks, data, or any other relevant evidence. In the past it has been known for one member of staff to distract an investigator, while another removes vital evidence. As time went on 3 other members of staff arrived for work, they were all taken aside and asked details of what there job involved, where there individual workstation was and any usernames, passwords or encryption keys that may be relevant to the case. On Entry On entry it was most important to visually identify anything that could be possible evidence. The following items were identified and noted down: – 1. Computer 2. Laptop 3. Usb stick 4. Digital camera 5. Printer 6. Scanner 7. Mobile Phones 8. Cd’s & Dvd’s 9. PDA All these items could be relevant in gaining evidence as they all may contain relevant data. My reasons for each item were as follows: – 1. Computer – This is obvious that looking for forensic data the desktop computer could hold lots of evidence. 2. Laptop – Same reasons as above. 3. Usb Stick – This could also contain data. 4. Digital Camera – may contain images or even files of any data 5. Printer – Printers have their own memory now so this could contain much needed evidence. 6. Scanner – May have been used to scan fraudulent documents (if there is any damage or imperfections to the glass this could show that a particular document was created with its use. 7. Mobile Phones – Mobile phones have own operating system, could contain not only contacts but also images, files, and time logs etc, lots of relevant data. 8. Cd’s & Dvd’s – Another item that could contain lots of data. 9. PDA – This like a mobile phone has its own operating system and could be used to store relevant data, contacts, time logs etc. Before any searches in drawers or anything was moved the whole area was photographed, picturing where all the above items were exactly in relation to the shop. This is done to document the evidence in a visual manner, that can be looked at after things have been moved to unsurface perhaps more clues, for example If a computer mouse was sitting on the left hand side of the desk, perhaps the manager is right handed so it could lead to a clue that perhaps a left handed member of staff uses that desk, which the computer is sitting on. Photographs were taken of the computer screen as it was on and had the user names on it, this was also documented by text. The computer felt quite warm so this could give clues as to whether it had been left on overnight or perhaps used before we had gained entry to the premises. Photographs were also taken of all the cables at the back of the computer, so as reconstructing at a later stage would be easier, also the cables were labelled. The desktop computer was then switched off by removing the power from the computer not the wall socket. The laptop was the next item to be dealt with, it was switched off so removal of the battery was next. Next a search took place which would involve looking in drawers, cupboards etc. The items I was looking for were: – 1. Any paper work that may give some clues to any passwords that may have been used 2. Memory Cards 3. Credit card Skimmers 4. Address books 5. Appointment cards/books 6. GPS SAT NAV equipment 7. CCTV footage Most of these items were found lurking in and around the vicinity of the desk where the desktop computer was located, other than the CCTV footage that was located in the DVD recorder next to the kitchen door. The DVD recorder contained a DVD- rw (DVD re- writable), which was left in place until also photographed and noted while in situ. The rest of the items were subsequently photographed and logged before anything else was done. The reasons for seizing these items were as follows: – 1. Paperwork – passwords, contacts etc. 2. Memory Cards – Data, Images 3. Credit card skimmers – Evidence in itself or even more so if there is data contained on the magnetic strip. 4. Address books – Contacts 5. Appointment cards/books – verify evidence of suspects whereabouts 6. GPS SAT NAV – Travel logs, previous places visited 7. CCTV – Evidence to say who has been in the premises, and when as the camera will have its own time logs. The manger was then asked a few questions about any passwords or encryption keys he may have been aware of, this was done to try and gain any extra information regarding passwords, encryption etc, as this could all save time when it comes to imaging and gaining access to files. All the questions and answers were noted down in a methodical manner. Seizing the evidence The decision was made by myself to take the equipment, rather than live image at the suspected crime scene, as there was no network, wireless or otherwise, I felt this was the best decision to make as the imaging could be done under labatory conditions. Also as there was quite an amount of electronic data that would need to be imaged, this would take far too long and would not be efficient to do so. Although it is seen best for the raw electronic data to be accessed least as possible due to its volatile nature, this would only have to be done the once in the lab, once imaged they actual items (pc, laptop) would not need to be handled again as the image would be an exact copy. Fingerprinting would need to be done, but this could not occur until all equipment had been imaged, as the chemicals used can be destructive The laptop was known to have Bluetooth capability, and wifi so this had to be put into a shielded box, so as that it could not receive any signals from anywhere else. The mobile phone and PDA were treated in the same manner. The boxes were tagged and everything noted so as to start the chain of evidence for these items. All that had to be done now was to actually bag up all the evidence. This has to be done and sealed in anti static bags, and all written down in a methodical manner. This was done item by item individually as each item was tagged and bagged it had to be logged in a chain of evidence. This took quite a long time but this job cannot be rushed, as anything missed could be fatal to a prosecution. Next was the issue of transportation, this would need to be done strategically so as not to damage any possible data evidence. These would have to be kept away from any magnetic fields, e. g. speakers, radios etc, so they were removed with a van that had storage boxes within so as the seized equipment would not get too warm, cold, or anything else happen to them. Evaluating the Evidence This is where the real investigation continues, and where more light may be shed on the situation concerning electronic data found. Encase was used to image the hard drive of the desktop computer and laptop, and various other software was used for the acquisition of the other electronic items. Once imaged work would begin on searching labouredly through the data. To finish this investigation could take quite a few man-hours, as there is so much data to work through. Now is when this case is turned over to the other specialists that I work alongside. Conclusion Alas my work has ended now in this case as I have finished my job of searching the crime scene and seizing the evidence, after a full week of preparation before the actual search, I am quite pleased with the result. I am no clearer about any crimes that were or may have been committed, but hopefully due to myself carrying out the investigation thoroughly I have led the way for a successful prosecution to go ahead.
